Public Relations FH-USU: Thursday (27/02/2025), Professor of Customary Law, Faculty of Law, Universitas Sumatera Utara (FH USU), Prof. Dr. Rosnidar Sembiring SH., M.Hum was trusted as one of the speakers in the Workshop on "Opportunities and Challenges for Recognition & Protection of Indigenous Peoples' Rights in North Sumatra" organized by the Customary Territory Registration Agency (BRWA), ICCA Indonesia Working Group (WGII) and the Indigenous Peoples' Alliance of the Archipelago (AMAN) Tano Batak Region, held at the Hermes Palace Hotel - Medan City, North Sumatra. This activity discussed Indigenous peoples' opportunities and challenges in fighting for their rights.
This activity lasted for 2 days; the first day was filled with Abdon Nababan (Indigenous Peoples' Alliance of the Archipelago) with the material "Opportunities for recognition and protection of Indigenous Peoples within the framework of national policy", then Dr. Sutarto, M.Si (Deputy Chairman of the North Sumatra DPRD) with the material "Regional Regulation on the Recognition and Protection of Indigenous Peoples in North Sumatra," then Heber Tambunan (Head of the North Tapanuli Environmental Service) with the material "The Struggle to Pioneer the Recognition and Protection of Indigenous Peoples' Rights in North Tapanuli," continued with the second day filled by Prof. Dr. Rosnidar Sembiring SH., M.Hum (Professor of Law, Universitas Sumatera Utara) with the material "Perspective on the Existence of Customary Land in North Sumatra", then Budi Hutasuhut (Batak Cultural Researcher) with the material "Natural protection through local wisdom of the "Surat Tembaga Holing" Pranata". The activities were carried out with interactive dialogues and sharing sessions.
This activity was attended by several institutions, namely the Customary Territory Registration Agency (BRWA), ICCA Indonesia Working Group (WGII), PW AMAN Tano Batak, Indonesian Coastal Conservation Foundation (YAKOPI), Indonesian People's Struggle Agency (BPRPI), North Sumatra Environmental Forum (WALHI - SU), Legal Aid and Advocacy of the North Sumatra People (Bakumsu), Medan Legal Aid Institute (LBH), Community Initiative Study and Development Group (KSPPM), and others.
In her presentation, Prof. Rosnidar said, "Why should we discuss the Customary Law Community first to resolve or take care of the administration and issues of customary land? Because the Customary Law Community is the subject of the customary land itself, so before discussing the object (customary land), the subject issue must first be resolved," said Prof. Rosnidar, opening the presentation.
"There are at least six MHA regulations in various regions of North Sumatra Province, namely Pakpak Bharat Regional Regulation No. 4 of 2017; Humbang Hasundutan Regional Regulation No. 3 of 2019; Langkat Regional Regulation No. 2 of 2019; Toba Regional Regulation No. 1 of 2020; Taput Regional Regulation No. 4 of 2021; Karo Regional Regulation No. 3 of 2021,” said Prof. Rosnidar.
“The Regency/City Regional Government is expected to immediately draft a Regional Regulation on the recognition of the existence and protection of Indigenous Legal Communities as a follow-up to the results of this research (Inventory and Identification) by referring to the applicable laws and regulations. However, it must also be acknowledged that the issuance of a Regional Regulation cannot immediately resolve land conflicts between MHA and the Government therefore this is also one of the driving forces to ratify the Draft Law on Indigenous Legal Communities immediately.”, said Prof. Rosnidar, closing the presentation.
