HUMAS FH-USU: Monday (06/07/2026), Twelve legal and environmental academics from various universities across Indonesia submitted an amicus curiae (friend of the court) brief to the Constitutional Court. The legal opinion was submitted two days before the conclusion of the judicial review hearing on the Job Creation Law, focusing on clarifying the controversy surrounding the existence of the Land Bank Agency.

One of the academics involved in preparing the legal opinion was Dr. Mirza Nasution, S.H., M.Hum., a lecturer at the Faculty of Law, Universitas Sumatera Utara (FH USU). His participation, alongside fellow academics, reflects an academic contribution aimed at providing an objective perspective to the Constitutional Court Justices regarding the existence of the Land Bank Agency.

The academics emphasized their position as neutral parties acting on the basis of academic moral responsibility, rather than in support of either the petitioners or the government. The legal opinion they submitted refutes arguments claiming that the Land Bank Agency is unconstitutional.

The amicus curiae brief highlights the slow resolution of land disputes and land distribution in Indonesia, which have long been hindered by bureaucratic obstacles. The Land Bank Agency is viewed as a practical alternative for breaking this cycle, enabling national agrarian management to be implemented more effectively and efficiently.

Of the twelve experts who prepared the document, six were present at the Constitutional Court building to officially submit the brief:

The legal opinion, developed through cross-regional academic collaboration, will now serve as one of the considerations for the Constitutional Court Justices before issuing their final decision regarding the future of Indonesia's national agrarian governance.
