Professor of Customary Law at the Faculty of Law, Universitas Sumatera Utara (FH USU), Prof. Dr. Rosnidar Sembiring, S.H., M.Hum appeared as a resource person in the Socialization of Prevention of Disputes, Conflicts and Land Cases and Regional Communication Strategies organized by the National Land Agency (BPN) Humbang Hasundutan. The socialization activity held at Coffee Hotel Ayoda Dolok Sanggul presented 4 speakers, namely the Head of the Legal Section of the Regional Government of Humbang Hasundutan Regency Syahrizal Simamora, S.H, Professor of Customary Law at the Universitas Sumatera Utara, Prof. Dr. Rosnidar Sembiring, S.H., M. Hum, Humbang Hasundutan Resort Police Bripda Daniel Sihombing, S.H., M.H, and Humbang Hasundutan District Attorney Gerry Anderson Gultom SH, MH.

 

The socialization activity raised the theme “Strengthening the Ownership Status of Customary Law Communities and Parhutaan in Humbang Hasundutan Regency in the First Time Land Registration Service at the Humbang Hasundutan District Land Office”. This socialization activity aims to understand the procedures for the First Time Land Registration Land Service in Humbang Hasundutan Regency and the realization of the mapping of parhutaan areas in Humbang Hasundutan Regency. The Head of the Legal Section of the Humbang Hasundutan Government presented material entitled “Strengthening the Ownership Status of Customary Law Communities and Parhutaan in Humbang Hasundutan Regency,” Humbang Hasundutan Police presented material entitled “Accelerating the Resolution of Customary Land Disputes and Conflicts,” Humbang Hasundutan District Attorney presented material entitled “Customary Land Crimes”, and Professor of Customary Law at the Faculty of Law, Universitas Sumatera Utara, presented material entitled “Recognition and Protection of Customary Law Communities (Study on Humbang Hasundutan Regency, North Sumatra Province).”

 

Prof. Dr. Rosnidar Sembiring, S.H., M.Hum, in her presentation, said that so far in North Sumatra Province, there have been 4 (four) Regional Regulations related to the recognition of indigenous peoples, namely in Humbang Hasundutan, Toba, North Tapanuli and Langkat Regencies. As for the four local regulations in question, there is only 1 (one) local regulation that clearly and explicitly provides recognition and protection of a particular customary law community, namely the Humbang Hasundutan Regency Regional Regulation Number 3 of 2019 concerning Recognition and Protection of the Pandumaan-Sipituhuta Customary Law Community. The settlement strategy for land registration of communal forest rights belonging to Mahudat Pandumaan Sipituhuta goes through 4 stages: Recognition of the existence of Mahudat Pandumaan-Sipituhuta; Determination of Mahudat Pandumaan-Sipituhuta's customary forest by the Ministry of Environment and Forestry; Settlement of Land Tenure in Forest Areas following Presidential Regulation No. 88 of 2017 by removing Mahudat Pandumaan-Sipituhuta from forest areas; and Registration of Mahudat Pandumaan-Sipituhuta's Communal Land.
