Master in Notary Study Program (MKn Study Program) of the Faculty of Law, Universitas Sumatera Utara (FH USU) held a Focus Group Discussion (FGD) related to the Problems of Land Compensation on Communal Land and in Forest Areas in Realizing Legal Certainty, at the GrandDhika Hotel Medan.

 

USU Faculty of Law Lecturer, Dr. Aflah, S.H., M.Hum moderated the focused discussion activity by presenting speakers Director General of Land Acquisition and Land Development, Ir. Embun Sari, S.H., M.Si., M.H. and Head of Master of Kenotariatan & Professor of Law at USU, Prof. Dr. Hasim Purba, S.H., M.Hum. This FGD activity was held to provide stakeholders with insight into the legal certainty of communal land compensation and forest areas and to increase understanding for lecturers and students of the MKn USU Study Program and practitioners related to contemporary issues in communal land compensation and forest areas.

In the focused discussion, it was discussed that the essence of land acquisition, in addition to the implementation of development for the public interest, is the provision of compensation to the entitled parties. The compensation is a fair and appropriate replacement for those whose rights are eliminated in the land acquisition process. Despite legal rules that serve as a legal umbrella in implementing compensation related to land acquisition for development purposes, disputes often arise between the government and the community regarding land acquisition, especially regarding communal land and forest areas. The dispute can be seen in the case of Pulau Rempang, the land for the State Capital (IKN) in Penajem. Therefore, the legal certainty of compensation for land acquisition for development purposes is questionable.
