The Faculty of Law, Universitas Sumatera Utara (FH USU), again held an International Guest lecture by presenting speaker Mr. Lau Kwan Ho, Assistant Professor of Law from Yong Pung Haw School of Law, Singapore Management University. This guest lecture raised the topic of E-Commerce and Electronic Contracts. The activity took place guided by FH USU Lecturer Lesly Saviera, S.H., M.H who acted as moderator and was attended by Lecturers and Students of the Bachelor of Law Study Program, Master of Law Study Program, and Doctor of Law Study Program Students, FH USU.


In his lecture class, Mr. Lau Kwan Ho conveyed that contract law in Singapore is largely based on general contract law in England. Therefore, the rules developed in Singapore courts bear a very close resemblance to the rules developed under English common law.

Mr. Lau Kwan Ho said, “Indeed, where there is no Singaporean authority specifically governing the matter, it will usually be assumed that the position, at the outset, will be no different to that in England. A contract is essentially an agreement between two or more parties, the terms of which affect their respective rights and obligations that are legally enforceable. Whether the parties have reached an agreement or a meeting of minds is objectively ascertained from the facts at hand. The concept of offer and acceptance is in many, though not all, cases the starting point for analyzing whether an agreement has been reached”, Lau Kwan Ho explained.

In conclusion, Mr. Lau Kwan Ho explained that Indonesia and Singapore have recognized the transformative potential of e-commerce and have taken steps to facilitate and regulate electronic contracts in their jurisdictions. As e-commerce continues to evolve, businesses and consumers must be aware of the legal aspects of online transactions and keep abreast of regulatory developments.
