An academic from the Faculty of Law, Universitas Sumatera Utara (FH USU), Dr. Syarifah Lisa Andriati, S.H., M.Hum became one of the speakers in a public discussion organized by the Directorate General of Legislation (Ditjen PP) in collaboration with the Regional Office of the Ministry of Law and Human Rights of North Sumatra, at the Aryaduta Hotel in Medan City. Other speakers were Trisakti University Faculty of Law academic Asep Iwan Iriawan, Expert of Commission III of the House of Representatives Afdhal Mahatta, and Director of Civil Affairs at the Directorate General of General Legal Administration Constantinus Kristomo. Yuli Rosdiana, an Associate Expert Legislation Designer, hosted the discussion.
In the public discussion on the Draft Law on Civil Procedure Law, Dr. Syarifah Lisa Andriati presented several responses, among others, related to examining cases with a fast event. She responded whether there were consequences related to cases that should have been examined with a fast event but then examined through ordinary events and every case that is refused to be examined with a fast event should include the reasons for the refusal in Article 94 paragraph (2) the category of cases is only based on the relationship of the agreement, what about the Unlawful Acts whose lawsuit value is below 500 million as contained in Perma 4 of 2019 should also be adopted in the Civil Procedure Law Bill, he said. Regarding evidence, Dr. Syarifah Lisa Andriati responded that expanding other evidence specified by law is an interesting thing in the Bill of Civil Procedure and can provide legal certainty related to the evidence used. However, the assessment is still left to the judge. According to her, Article 103, paragraph (1) should contain an explanation of each piece of evidence. Dr. Syarifah Lisa Andriati also responded that obstacles in the field are often encountered when court decisions are to be implemented (executed). There must be a clear list of execution costs to provide legal certainty for parties who want to request execution in the derivative rules of the Civil Procedure Bill.
This public discussion activity aims to enrich the concept of civil procedure law through direct input from various stakeholders in the field of law. After the presentation of the material by the speakers, the discussion was continued with a question and answer session by the participants. This activity is expected to capture various inputs from different perspectives and further enrich the substance of the Civil Procedure Law Bill.
