The Study Board of the People's Consultative Assembly of the Republic of Indonesia (MPR RI) and the Faculty of Law Universitas Sumatera Utara (FH USU) collaborated to study the Types of MPR Decisions. The activity was conducted as a focus group discussion at Hotel d'prima in the Kuala Namu area, Deli Serdang, North Sumatra. The FGD was conducted to receive input from some experts in constitutional law and legislative science of FH USU related to various legal issues in the form of MPR RI decisions.
Present in the FGD activities representing the MPR RI Study Board, including Dr. Tr. Agun Gunandjar Sudarsa, Bc.IP, M.Si (Golkar Party Faction), H. Johan Rosihan, ST (PKS Faction), Slamet Ariyadi, S.Psi (PAN Faction), Sudirman (DPD Group), and Muhammad Nuh, M.SP (DPD Group). While from FH USU, the Dean of FH USU, Dr. Mahmul Siregar, SH, M.Hum, and several experts in constitutional law and legislation of FH USU, namely Dr. Faisal Akbar, SH, M.Hum, Dr. Afnila, SH, MH, Yusrin, SH, MH and Armansyah, SH, M.Hum.
In his remarks, the Dean of FH USU expressed his appreciation and gratitude to the MPR RI Study Board for giving confidence to collaborate with FH USU. This FGD activity is the umpteenth activity carried out by FH USU and the MPR RI Study Board. Collaboration like this, besides providing benefits for the development of FH USU, is also part of FH USU's contribution to society, nation, and state. As a higher education institution, it is the obligation of FH USU to contribute to providing ideas for various problems faced by society and this nation.
On the same occasion, the MPR RI Study Board coordinator, Dr. Tr. Agun Gunandjar Sudarsa, Bc.IP, M.Si expressed his gratitude to FH USU for being willing to cooperate and contribute ideas and thoughts on various legal issues faced by the MPR RI. It was further explained that the MPR RI faced various legal issues in carrying out its authority, duties, and functions as a state institution after the 1945 Constitutional Amendment. The FGD will focus on various legal issues related to the types of MPR RI decisions.
The Focus Group Discussion activity is intended to explore in more depth the MPR Regulation Number 1 of 2019 concerning the Rules of Procedure of the MPR, especially in Article 99 and Article 100 related to the use of the nomenclature “Decision” as a legal product of the MPR. Furthermore, regarding the MPR Decree as a legal product of the MPR RI. MPR after the amendment of the 1945 Constitution, the Republic of Indonesia no longer has the authority to make MPR decrees like regulation (regeling). Still, in MPR Regulation Number 1 of 2019 concerning MPR Rules of Procedure Article 99 and Article 100, MPR decrees like regulation (regeling) are regulated. The MPR, after the amendment of the 1945 Constitution of the Republic of Indonesia, still has the authority to make MPR decrees like stipulations (beschikikng). Still, in MPR Regulation Number 1 of 2019 concerning MPR Rules of Procedure Article 99 and Article 100, it does not regulate MPR decrees like stipulation (beschikking). Is the regulation of the type of decision contained in MPR Regulation Number 1 of 2019 concerning MPR Rules of Procedure Article 99 and Article 100 appropriate and under the authority and duties of the MPR as stipulated in the 1945 Constitution and the MD3 Law?
The discussion between legal experts and MPR RI Study Board members was very sharp and in-depth. Various thoughts on philosophical and normative juridical aspects to respond to these issues have been produced as input for the MPR RI Study Board to make decisions under its authority. At the end of the discussion, the MPR RI Study Board coordinator expressed his appreciation to the experts who had provided a strong and useful legal perspective for decision-making in the MPR RI.
